Tier 1 · Original regulation of Law 24/1992
Executive Decree 89 of June 8, 1993
Regulates Law 24 of 1992 (Reforestation Incentives). Defines Forest Registry registration procedures, plantation certification and operational application of Law 24 exemptions. Its scope changed after derogation of Articles 6 and 7 of Law 24 by Law 69 of 2017.
What this decree regulates
- Forest plantation registration procedures in the Forest Registry (originally ANAM, today MiAmbiente).
- Technical certification of reforestation projects.
- Operational application of tax exemptions provided in Law 24/1992.
- Inspections and compliance verification.
Articles 9, 10 and 14 are the most cited in Panama's Administrative Tax Tribunal rulings on application of forestry incentives.
Impact of Law 69/2017
When Articles 6 and 7 of Law 24/1992 were derogated (containing direct incentives and income tax exemption), provisions of this regulation governing operational application of those articles became without effect in their fiscal part. Administrative provisions on Forest Registry registration and certification remain in force.
