Tier 1 · Regulation of current incentive regime
Executive Decree 129 of 2018 — Regulation of Law 69/2017
Operationalizes the Reforesta Panamá Program. Defines how to apply to the Fund, which activities qualify for direct subsidy, amounts per hectare, technical controls and timelines. It is the piece that turns Law 69/2017 into applicable public policy.
What this decree operationalizes
- Reforesta Panamá Fund — governance, board of directors, mixed administration.
- Eligibility criteria for incentives: activity type (reforestation, restoration, assisted regeneration, agroforestry, silvopastoral, conservation), minimum size, location, land tenure.
- Application procedure — forms, required documents, technical evaluation.
- Subsidy amounts — per hectare and per activity type, per Ministry's technical schedules.
- Monitoring and control — plantation verification, sanctions for non-compliance.
- Coordination with MiAmbiente, MEF (Ministry of Finance) and cooperating entities.
For whom it is relevant
Forestry investors seeking fiscal-economic benefit today operate primarily under this decree (not under the original Law 24/1992 exemption regime, partially derogated). Registered forestry operators can facilitate Fund application for their investors as part of the service package.
